Kolkata has a long tradition of art colleges, life-drawing classes and photographers working with the human body, and the press has reported on this world, for example The Times of India’s feature “The secret world of Kolkata’s nude models”. People also search for how to start in nude photography or how to find a model. This page answers the part that matters most: what the law says and how to avoid being harmed.

Is nudity illegal in India?

No. Nudity alone is not obscenity. In Aveek Sarkar v. State of West Bengal (2014), a case from this state, the Supreme Court dealt with a published photograph of the tennis player Boris Becker and his fiancée. The court moved away from the old Hicklin test and applied a “community standards” test, looked at the picture in context, separated art and social comment from material meant only to excite, found no obscenity, and quashed the criminal proceedings (Wikipedia summary; (2014) 4 SCC 257). Context decides.

The laws that still apply

  • Obscenity: selling or circulating obscene material is an offence under Section 294 of the Bharatiya Nyaya Sanhita, which replaced Section 292 of the IPC from 1 July 2024. Sources disagree on the exact fine, so check the bare Act.
  • Online publication: the Information Technology Act has separate provisions on publishing obscene or sexually explicit material in electronic form (Sections 67 and 67A).
  • Consent and privacy: capturing or sharing a person’s private images without consent can be an offence, under the BNS voyeurism provision (Section 77, which replaced IPC 354C) and the IT Act (Section 66E).
  • Age: anyone under 18 cannot give consent to this work. Images of a minor are a serious crime under the POCSO Act. Always see proof of age.

Legal and unlawful are decided by facts, so anyone planning a project should ask a lawyer.

How art modelling works

Life-drawing and figure classes at art institutions and recognised drawing groups hire adult models for a set session, in a studio with rules: the model is told what the session is, can stop at any time, and no one photographs them. The safest way into this work is through such institutions, asking them directly, and not through anonymous online posts.

Red flags for models

  • A request for a fee or “registration money” before any work.
  • An “audition” or film role that needs nude photographs to be sent first.
  • Contact only by WhatsApp or Instagram, no name, no address, no company.
  • No written agreement on what will be shot, where it will be used and for how long.
  • Pressure to go further than agreed, or to shoot alone in a private place.

Rules for models

  • Meet first in a public place, tell someone where you are going, and take a friend to the first session if you can.
  • Get a written agreement: who owns the pictures, where they can be published, for how long, what you are paid, and that you can withdraw consent.
  • Do not send private images to people you have not met. Images sent online can be copied and used to blackmail.

Rules for photographers

  • Check proof of age and keep a signed model release for every shoot.
  • Pay what you agreed, in the agreed way, and do not use or share the pictures outside the release.
  • Do not publish identifiable nude images without clear written consent for that exact use.
  • Shoot in a private, safe place the model has agreed to.

If images were shared without consent

Report them at the national cybercrime portal, cybercrime.gov.in, and in an emergency call 112. The free tool StopNCII.org can help stop intimate images spreading on major platforms. If you have paid someone because of a threat or scam, the financial cybercrime helpline is 1930.
